Terms of Service
These Terms govern your access to and use of Apex Scholars websites, communications, and paid academic support services.
- Effective
- Last updated
This is a living policy. We may update it as Apex Scholars evolves; material changes will be reflected by the “Last updated” date on this page.
1. Agreement to these Terms
By accessing our website, requesting a consultation, creating an account, or purchasing services, you agree to these Terms of Service (“Terms”) and our Refund & Cancellation Policy. If you do not agree, do not use Apex Scholars.
These Terms form a binding agreement between you and Apex Scholars (“we,” “us,” or “our”). If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
2. What Apex Scholars offers
Apex Scholars provides premium ethical academic support. Depending on the engagement, that may include:
- One-to-one tutoring and subject coaching
- Writing-process guidance, outlining support, and structural feedback
- Editorial review for clarity, organisation, grammar, and citation form
- Research literacy coaching (finding, evaluating, and citing sources)
- Study skills, time planning, and academic confidence support
Services are delivered by qualified educators and editors according to the scope described in your order confirmation or statement of work.
3. Academic integrity disclaimer
Apex Scholars does not write essays, dissertations, exams, or other assessed work for you to submit as your own. We do not provide ghostwriting, essay-mill services, purchased solutions intended for submission without disclosure, or any guarantee of grades, marks, or admissions outcomes.
You remain solely responsible for complying with your institution’s academic integrity, honour code, and assessment rules. You must:
- Use our guidance, edits, and tutoring to improve your own learning and writing
- Disclose assistance where your institution requires it
- Not misrepresent our work as solely your own original authorship
- Not request services that would constitute plagiarism, contract cheating, or exam misconduct
We may refuse, pause, or cancel any request that we reasonably believe would facilitate academic misconduct. Fees for refused misuse requests are handled under our Refund & Cancellation Policy.
4. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase Services. If you are under that age, a parent or legal guardian must enter into these Terms on your behalf and supervise your use.
You agree to provide accurate contact and payment information and to keep account credentials confidential. You are responsible for activity under your account.
5. Orders, scope, and payment
Payment is due before work begins, unless we expressly agree otherwise in writing. Prices, deliverables, timelines, and revision allowances are set out at checkout or in your order confirmation.
Included revisions are limited as described in the Refund & Cancellation Policy (maximum of two rounds of revisions within the agreed scope, unless a different package is purchased). Work outside the agreed scope may require a new order or change request at then-current rates.
You authorise us and our payment processors to charge the payment method you provide. Taxes may apply based on your location.
6. Your responsibilities
You agree to:
- Provide materials, briefs, and deadlines that are accurate and lawful
- Respond to clarifying questions within a reasonable time so we can meet agreed timelines
- Use deliverables only for lawful, ethical academic purposes consistent with Section 3
- Not upload malware, infringing content, or others’ confidential information without permission
7. Acceptable use
You must not:
- Request ghostwriting or submission-ready assessed work to be passed off as solely yours
- Seek guaranteed grades, exam answers for live assessments, or impersonation
- Harass staff, other users, or attempt to circumvent security or payment controls
- Scrape, reverse engineer, or misuse the website except as allowed by law
- Resell our Services without our prior written consent
8. Intellectual property
The Apex Scholars name, branding, website design, and platform content are owned by us or our licensors. You receive a limited, non-exclusive licence to use feedback, tutoring notes, and editorial comments we provide to you for your personal educational use, subject to these Terms and your institution’s rules.
Materials you submit remain yours. You grant us a limited licence to use those materials solely to deliver the Services and improve our operations (for example, quality review), consistent with applicable privacy law.
9. Disclaimers
Services are provided on an “as available” basis. While we aim for professional, careful guidance, we do not warrant that tutoring or editing will achieve any particular grade, score, publication, or admissions result. Academic outcomes depend on many factors outside our control, including your prior preparation, institutional criteria, and assessor judgement.
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Apex Scholars and its personnel will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of grades, opportunity, profits, or data, arising from your use of the Services.
Our aggregate liability for claims arising out of these Terms or the Services is limited to the amount you paid us for the specific Service giving rise to the claim in the twelve (12) months before the claim. Nothing in these Terms excludes liability that cannot be limited under applicable law (including for fraud or death/personal injury caused by negligence where such exclusion is prohibited).
11. Suspension and termination
We may suspend or terminate access if you breach these Terms, request prohibited services, fail to pay, or misuse the platform. You may stop using the Services at any time. Provisions that by nature should survive (including Sections 3, 8-10, 12-14) survive termination.
12. Changes to the Services or Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use after posting constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent for material changes.
13. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise. Courts of England and Wales have exclusive jurisdiction, subject to those mandatory rights.
If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.
